MISCELLANEOUS ACT as per ARTICLE 4(5) and 14(4)

These shall be set up under the miscellaneous act of the party’s constitution and shall be bound to change from time as per the national executive council’s decision.

THE PARTY’S NOMINATION RULES AND PROCEDURES (REVISED ).

These rules and procedure are made pursuant to articles 4(5) of the party constitution.

A. The National Elections Board.

1. The National elections boards as provided for in article 4.5 of the party constitution to work under the national executive council.
2. The national executive council shall either by itself or through a committee constituted by it, request each of the 47counties to submit its names of one (1) person who should be of either gender for consideration for nomination to serve as a member of the national elections board. Such members must be serving members of the county election board for purposes of continuity.
3. Upon the receipt of the names from the county branches, the National executive council or its committee shall prepare a list of all the names submitted to it and call a special N.E.C meeting review and select seven members from the list of candidates presented to serve as a members of national elections board in order of priority ensuring that one third of the seven (7) shall be of either gender.
4. The national executive council shall short-list the candidates according to the ranking as is made from branches and it shall also ensure gender balance.
5. In the final list all of the successful candidates must come from different branches.
6. The Deputy party Leader shall be the Chairman of the national election board as a representative for the National Executive Council.
7. The national executive council shall also elect the Director of National Election Board from the seven (7) successful candidates.
8. The national elections board in the exercise of it powers under article 4.5.7 of the party constitution will establish county election boards in every county in order to assist carry out its functions as stipulated therein.

B. The County Elections Board

1. The national elections board shall call upon members of the party who are not
Party officials at any level and are holders of life membership having been
Active members of the party for least two (2) years or for a reasonable period as it
May resolve to apply for appointment as members of the county elections boards.

2. Upon receipt of the said application, the national elections board will appoint five
of the applicants to constitute the branch elections board. The members of county
elections board may not necessarily come from the same branch.

3. At least a third (1/3) of the members of the county elections board shall be of either gender.

4. No member of the county elections board shall be allowed to contest for
presidential, senatorial, governorship, parliamentary or civic seat unless he/she resigns as a member of the said board at least not less than six (6) months before the national elections.
5. The national elections board shall establish the County Election board at least nine (9) months before the scheduled national elections.
6. The county election boards shall oversee all local party elections and nominations within all branches in the counties under the supervision of the National elections board.
7. The County elections boards shall cease its operations one month after the
Conclusion of the National General Elections. However, where there is an appeal, its operations shall cease one (1) month after the appeal.
7. The party nominations of its candidate for purposes of contesting the National
Elections shall be conducted in the manner herein below provided for.
8. At least third(1/3) of the members of the County Elections Board shall be of either
gender.
9. All Internal Party Elections for purposes of nominating party candidates for elections to the National General Elections shall be carried out three (3) months before the scheduled National General Elections and Names forwarded to the party’s National election board for adoption.
10. The party nominations of its candidates for purpose of contesting the national
elections shall be conducted in the manner herein below provided for.

NATIONAL GENERAL ELECTIONS

C) Nomination for the Party Presidential candidate

1. The national elections board shall give notice by advertisement to all members
wishing to be nominated as the party’s presidential candidate to apply for the said
nominations at least 21 days form the date of the national annual delegate’s
conference or the special national delegate’s conference. The national delegate's
conference shall be held not later than twelve months (12) months before a
National General Elections.
2. The national elections board will on receiving the applications scrutinize the
same and issue the cleared applicants with a certificate of compliance for
nomination.
3. The national elections board shall present the list of cleared applicants to the
national annual delegate’s conference or a special national delegate’s conference
for the appropriate resolution.
4. Qualification for nomination as the party’s presidential candidate

For one to qualify for nomination as party’s presidential candidate he or she must
have the following qualifications:-
(a) Be a life member of the party
(b) Be a holder of a Kenyan identify card
(c) Be a registered voter
(d) Must have passed the English and Swahili proficiency test
(e) Must be vast with past and current national and international political affairs
(f) Must have served the party for not less than one year as a national executive council member or as may be resolved by the national annual delegates conference or special national delegates conference
(g) Must undertake to abide by the party’s constitution
(h) Must be a person of integrity and poses a certificate of good conduct from the Kenya police.
(i) Must be supported by at least a thousand party members from at least 24 of the 47 counties
(j) Must pay the party’s nomination fees of Kshs.500,000/=
(k) Must comply with the presidential election rules as stipulated under the Kenyan constitution and chapter 9 of the laws of Kenya
(l) Must denounce publicly any other membership to any other political party and join NEW DEMOCRATS officially at least twelve (12) months before the general elections or special presidential elections.

5. Nomination for the party senatorial, governors and women leader’s candidates

(a). The national Election board shall give notice to all county election boards to
Proceed and conduct nominations for the purpose of electing party candidates to
Posts of the senators, governors, deputy governors for the purpose of the
national general elections or mini elections.
(b). The nominations for the above candidates shall be done three (3) months before
a national general elections and such names forwarded to the national elections
Board and the national executive council.
(c). All candidates aspiring to the senators/governors and deputy governors must
Comply with all other rules that govern the nomination procedures for the
Parliamentary candidates.
(d). Candidates aspiring to be nominated to the post of senators must poses at least a
Degree from a recognized university and be well versed with all issues relating
To the counties they wish to represent as well as the national and international
Political system.
(e). Candidates who aspire to be nominated to the post governor and deputy
Governors must be university graduates and poses a degree from a recognized
University besides being well versed with the county and national politics.

(f). Candidates to be nominated to the post of senators post shall pay to the party
a nomination fee of kshs.200,000/-
(g) Candidates to be nominated to the post of governor’s post shall pay to the party a nomination fee of kshs.200, 000/-
(h) Candidates to be nominated to the post of deputy governor’s post shall pay to
the Party a nomination fee of kshs.100, 000/-
(i). all aspirants for governor, senatorial shall pay a life membership fees of kshs.50,000/=.
(j).candidates for deputy governor shall pay a life membership fee of Kshs. 20,000/=

All other procedures and rules for nomination to the above candidates shall proceed
as per part (6.e) below.

NOTE: All women candidates and youth below Age of thirty five (35) years shall be charged at 50% of the above fees payable.

6. Nominations for the party parliamentary candidates

(a). The national elections board or county elections boards shall give notice by
advertisement to all members wishing to be nominated as the party’s
Parliamentary candidates to apply for the said nomination at least six (6) months
before the end of the parliamentary term or as may be determinate by the national
executive council if national elections are called earlier than expected or in areas
where no applications were made, or during by- elections.
(b). The national elections board or the county elections boards will on receiving the
applications scrutinize the same and issue the cleared application with a certificate
of compliance for nomination.
(c). The national elections board or branch election board shall set a nomination date
and communicate the same to the party and the contestants.
(d). The national elections board or County elections boards shall designate a central
place in each ward within each constituency and all the members of the party
within the particular ward shall conduct the nomination at the designated places.
(e). The national elections board or county elections boards shall count all the votes
cast at the designated places and shall do the tallying at a tallying station it
identifies within the constituency/ward. Voting shall be by secret ballot and winning shall be by simple majority.

(f). The national election board or County elections boards shall announce the results at the tallying point and declare the winner and shall present the result slip to the Party Secretary General who shall issue the winner with duly signed nomination certificate for presentation to the (IEBC).

(g). The people eligible to vote for the nomination of the party’s parliamentary
candidates shall be registered party members who are registered voters within the
wards in the particular constituencies.
(h). The national elections board or County elections board shall use the register of
the party members within the wards as shall have been supplied to them by the
Secretary General at least fourteen (14) days before the date of the scheduled
nominations.
(i). The declared winner shall be the nominee of the party to contest for the national
election or by-elections for the said constituency unless, in case of an appeal as is
otherwise held by the elections appeals board.

7. Qualification for nomination as the party’s parliamentary candidate

For one to qualify for nomination as the party’s parliamentary candidate he or she
must have the following qualifications:-
a. Be a life member of the party
b. Be a holder of a Kenyan identify card.
c. Be a registered voter
d. Must have passed the English and Swahili proficiency test
e. Must be vast with past and current national and international political affairs
f. Must undertake to abide by the party’s constitution
g. Must be a person of integrity
h. Must pay the party’s nomination fees of Kshs.100,000/=
i. Must comply with the parliamentary elections rules as stipulated under the Kenyan constitution and chapter 7 of the laws of Kenya.
j. Must denounce publicly any other membership to any other political party and join NEW DEMOCRATS officially not lees than four (4) months before the scheduled general elections.
k. All National Assembly i.e (MP) Aspirants must party a life membership fees of Kshs. 20,000/= besides the nomination fees.

8 . Nomination for the party’s civic/regional candidates.

(a). The national elections board or county election boards shall give notice by
advertisement to all members wishing to be nominated as the party’s civic
candidates to apply for the said nomination at least six(6) months before the end
of the parliamentary term or as may be determined by national executive council
in event the national elections are called earlier than expected.
(b). The national elections board or county elections boards will on receiving the
applications, scrutinize the same and issue the cleared applicants with a certificate
of compliance for nomination.

(c). The national election board or county election boards shall set a nomination date
and communicate the same to the party and the contestants provided that the same
shall not be later than seven days before the deadline set by the electoral
commission of Kenya.
(d). The national elections board shall designate a central place in each ward and all
members of the party within the particular ward shall conduct the nomination at
designated place unless the management council otherwise decide. Voting shall
be secret ballot and winning shall be simple majority.
(e). The national elections board or county elections board shall count all the votes
cast at the designate place and shall announce the results and it shall present the
result slip to the secretary general who shall issue the winner with a duly signed
Nomination certificate.
(f). The people eligible to vote for the nomination of the party’s civic candidates shall
be registered party members who are registered voters within the particular ward.
(g). The national elections board or county elections boards shall use the register of the party members within the particular ward as shall have been supplied to them by
the secretary general at least fourteen (14) days before the date of the scheduled
Nominations
(i). The declared winner shall be the nominee of the party to contest for the national
Elections or by-elections for the said ward unless, incase of an appeal, as is
Otherwise held by the national election appeals board.

9. Qualifications for nomination as the party’s civic/regional candidate.
For one to qualify for nomination as the party’s civic candidate he or she must
have the following qualifications:-
(a) Be a life member of the party
(b) Be a holder of a Kenyan identify card
(c) Be a registered voter within the ward he or she seeks contest for
(d) Must be vast with local political issues within the ward he or she seeks to contest for
(e) Must undertake to abide by the party’s constitution
(f) Must be a person of integrity
(g) Must pay the party’s nomination fees of Kshs.20,000/=
(h) Must comply with the election rules as stipulated under the local government act or any other relevant law.
(i) Must officially denounce any membership to any other political party other than NEW DEMOCRATS.
(j) All County assembly Aspirants must pay a life membership fees of Kshs. 10,000/= besides the nomination fees.

10. The elections appeals board

There shall be an elections appeals board which shall handle all internal elections disputes within the party. The Elections appeals board shall be constituted from the members of the national election board and four (4) other members from the NEC or as may be decided by National Executive Council. The National Executive Council shall constitute the Elections appeals board three (3) months before the scheduled National General Elections.

11. Roles and Obligations

11(1)The elections appeals board shall receive, hear and determine all complaints
Emanating from the nomination exercise as conducted by the national elections
board and or branch elections.
11(2)Any member whether a contestant or an aggrieved voter in the party nominations
shall within seventy two(72) hours, after the happening of the event and upon
payment of an appeal fees of Kshs. 50,000/= for civic candidate and Kshs. 1,000,000/=
for a parliamentary candidate, lodge a written complaint to the elections appeals
board.
11(3). The complaint must specify the following details:-
a) The name and description of the complainant
b) The act or omission complained about
c) The name and description of the person whose act or omission is the subject of the complaint
d) A brief statement describing the act or omission complained about.
11(4) The election appeals board shall on receipt of the written complaint and upon being
satisfied on the competency of the complaint, call upon the complainant and the
person against whom the complaint is made , within seventy two (72) hours of the
receipt of the complaint to present it any evidence or proof either for or against the
complaint, after which it shall make its finding and give directions or decisions
thereof.

12. Elections of the regional council members

(a). The national elections board shall advertise to all party members wishing to contest
any of the regional executive council positions to apply for nomination to contest for
the same at least 21 days before the date of the regional annual delegate’s conference
or special regional delegate’s conference.
(b). The national elections board shall issue certificate of compliance to all applicants it
has cleared.
(c). The national elections board shall publish the names of the cleared applicants and
inform all the branches about the said names for the branch records.
(d). The national elections board shall preside over the elections at the regional annual
delegate’s conference or special regional delegate’s conference either by itself or by
the assistance of the electoral commission of Kenya or any other relevant body.
(e). The elections of the party officials shall be by the secret ballot and simple majority
shall decide the winners.
(f). The national elections board shall count announce the results and declare the winners
at the conference.
(g). The national elections board shall present the list of the elected officials to the
secretary general for purposes of keeping proper records.

13. Qualifications for election as a national /regional executive council member For a party member to qualify to be elected as a national/ regional executive council member, he or she shall have the following qualification:-
i. Must be a life member of the party.
ii. Must have served as registered members of the party for at least one (1) year.
iii. Must have a Kenyan National identify card
iv. Must be a registered voter
v. Must pay prescribed fees as may be decided by the party from time to time fees to contest for the various elective positions.

I4. Elections of the branch council members.
(a). The national elections board or branch elections board shall advertise to all party
members wishing to contest any of the branch council positions to apply for
nomination to contest for the same at least 21 days before the date of the branch
annual delegate’s conference or a special branch delegate’s conference.

(b). The national elections board or branch elections board shall scrutinize the
applications and shall issue certificate of compliance to all applicants it has cleared.
(c). The national elections board shall publish the names of the cleared applicants and
inform all the sub branches’ records.
(d). The national elections board or branch elections board shall preside over the elections
at the branch annual delegate’s conference or special branch delegate’s conference
either by itself or by the assistance of the electoral commission of Kenya or any other
relevant body.
(e). The elections of the party officials shall be by secret ballot and simple the majority
shall decide the winners.
(f). The national elections board or branch elections board shall count, announce the
results and declare the winners at the conference.
(g). The national elections board or branch elections board shall present the list of the
elected official to the secretary general for the purpose of keeping records.

15. Qualification for elections as a branch council member

For a party member to qualify to be elected as a branch council member he or she
shall have the following qualifications:-
a) Must be either a life member or a seasonal member
b) Must have a Kenyan identify card
c) Must be a registered voter
d) Must pay nomination fees of Kshs.1,000/= for the position of chairperson, secretary general, treasurer and the organizing secretary and their deputies.

16. Elections of the sub-branch council members

(a). The national elections board or branch elections board shall advertise to all party
members wishing to contest any of the branch council positions to apply for
nomination to contest for the same at least 21 days before the date of the sub-branch
annual general meeting or special sub-branch general meeting.
(b). The national elections board or branch elections board shall scrutinize the
applications and shall issue certificate of compliance to all applicants it has cleared.
(c). The national elections board shall publish the names of the cleared applicants and
inform all the members within the sub-branch general meeting about the said names
for the sub-branch’s records.
(e). The national elections board or branch elections board shall preside over the elections
at the sub-branch annual general meeting or special sub-branch general meeting either
by itself or by the assistance of the electoral commission of Kenya or any other
relevant body
(f). The elections of the party officials shall be secret ballot and simple majority shall
decide the winners.
(g). The national elections board or branch elections board shall count and announce the
results and declare the winners at the conference.

All party elections shall be conducted under the above rules party rules and regulations and may be subject to further regulations as maybe prescribed by the registrar of political parties and the independent electoral and boundaries commission (IEBC).

The national executive council shall review the rules and regulations from time to time to address any legal technicalities.

NOTE: all party members aspiring for any party office across the country shall pay a life membership fee of kshs: 5,000/= and shall be issued with a life membership certificate:
